NOTICE OF PROPOSED CLASS ACTION SETTLEMENT

You are not being sued. This notice affects your rights. Please read it carefully.

As a current or former non-exempt California employee of Medical Depot, Inc. – whether directly employed Medical Depot, Inc. or assigned by any temporary staffing agency to perform work as a temporary worker for Medical Depot, Inc. – you could get a payment from a class action settlement.

Class Members are all current and former non-exempt, hourly employees – whether directly employed by Medical Depot or assigned by any temporary staffing agency to perform work as a temporary worker of Medical Depot – who worked at any of Medical Depot’s California facilities at any time during the period of May 14, 2017, through May 28, 2023 (this time period is referred to as the “Class Period”).

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:

DO NOTHING AND RECEIVE PAYMENT

Get a payment and give up your legal rights to pursue claims released by the settlement of the lawsuit. If you are still employed by Medical Depot and choose to receive a settlement payment, this will not affect your employment.

EXCLUDE YOURSELF

Exclude yourself from the settlement, get no payment, and retain your legal rights to individually pursue the claims that would otherwise be released by the settlement of the lawsuit.

OBJECT

If you do not opt out, you may write to the Settlement Administrator, Simpluris, about why you object to the settlement, and they will forward your concerns to counsel which will then be provided to the Court. If the Court approves the settlement despite your objection, you will still be bound by the settlement.

  • These rights and options—and the deadlines to exercise them—are explained in the notice.

  • The Court still has to decide whether to approve of the settlement. Payments will be made if the Court approves the settlement. Please be patient.

  • The Final Approval Hearing on the adequacy, reasonableness, and fairness of the Settlement will be held at 8:30 a.m. on March 6, 2024, at the San Bernardino County Superior Court in Department S26 before Judge Jessica Morgan, located at 247 W. 3rd Street, San Bernardino, CA 92415. You are not required to attend the hearing, but you may do so.
